Employment Appeals

All employees are entitled to appeal a finding from a workplace investigation, grievance or disciplinary hearing and they do so generally because they feel they have just cause.  Often, the basis for the appeal is a flaw in the procedure, concerns about the impartiality, skill or competence of the decision maker.

An appeal hearing is equally critical for you, as an employer, as for the parties involved.  It is generally, the final opportunity to examine the element under appeal – the process, decision, sanction or finding – to ensure it is fair, impartial and appropriate and one which will withstand the scrutiny of the courts.  The person(s) conducting the appeal must also be independent of the preceding process and the parties involved.
